1. Introduction & Acceptance of Terms

Welcome to imsafedrive. These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "Client"), and imsafedrive ("we", "us", or "our"), concerning your access to and use of our professional safe driver and chauffeur services in the United Arab Emirates.

By booking our services via our website, WhatsApp, phone call, or any other communication channel, you acknowledge that you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, you are expressly prohibited from using our services and must discontinue use immediately.

2. Scope of Services

imsafedrive provides RTA-licensed, background-checked, and professional safe drivers to chauffeur Clients in the Clients' own vehicles. Our services include, but are not limited to, hourly driving, daily hires, weekly packages, airport transfers, corporate transfers, school runs, and monthly safe driver contracts across all seven Emirates of the UAE.

Our drivers are assigned to drive the vehicle provided by the Client. We do not provide the physical vehicle as part of our safe driver services unless explicitly booked under a separate luxury car rental with chauffeur agreement.

3. Client Representations & Vehicle Requirements

To ensure the safety of our drivers and passengers, the Client represents, warrants, and covenants that:

• The vehicle provided is fully registered in accordance with UAE federal laws and RTA regulations, and a valid registration card (Mulkiya) is present in the vehicle.
• The vehicle is covered by a valid, comprehensive motor insurance policy issued by a registered insurer in the UAE, which covers third-party drivers.
• The vehicle is in a safe, roadworthy condition, free from mechanical, electrical, or structural defects, and complies with all safety requirements (including fully functional seatbelts, brakes, lights, and valid tyres).
• The vehicle contains sufficient fuel for the requested journey, along with a functioning air conditioning system.

Our drivers reserve the right to inspect the vehicle registration and refuse service immediately if the vehicle is deemed uninsured, unregistered, unsafe, or mechanically compromised. In such cases, a late cancellation fee will apply.

4. Bookings, Confirmation & Pricing

All bookings are subject to availability. Online form submissions are treated as inquiries. Bookings are officially confirmed only when an agent sends a confirmation message via WhatsApp or calls you directly.

Our prices are quoted in United Arab Emirates Dirhams (AED). Rates depend on the service package selected:

• Hourly Bookings: Charged at a standard hourly rate with a minimum booking duration of 2 hours.
• Tolls & Parking: All toll fees (Salik) and public or private parking charges incurred during the journey are the sole responsibility of the Client and will be added to the final fare or paid directly by the Client.
• Fuel & Consumables: The Client is fully responsible for all fuel costs, vehicle consumables, and cleaning costs.

5. Cancellation, Modifications & No-Show Policy

We value our drivers' time and schedule. Our cancellation terms are structured as follows:

• Free Cancellation: Bookings can be cancelled or rescheduled free of charge up to 2 hours prior to the scheduled pickup time.
• Late Cancellation: Cancellations or rescheduling requests made within 2 hours of the scheduled pickup time will incur a 50% charge of the total estimated booking value.
• No-Shows: If the driver arrives at the designated pickup location and the Client does not appear within 15 minutes without communication, the booking will be treated as a no-show, and the Client will be charged the full amount of the booking.

6. Traffic Fines, Tolls & Accidental Liability

Our drivers are trained professionals who strictly adhere to all UAE traffic regulations, including speed limits, lane disciplines, and parking laws.

• Driver's Fault: If a traffic fine (e.g. speeding, running a red light, illegal parking, lane violations) is issued as a direct result of the driver's negligent action, imsafedrive will take responsibility for paying the fine upon verification of the fine date, time, and location.
• Vehicle's Fault: Fines related to vehicle maintenance, expired registration, non-functional headlights/indicators, missing spare tyres, tinted windows exceeding legal limits, or any pre-existing mechanical issue are the sole responsibility of the Client.
• Insurance Excess: In the highly unlikely event of an accident where our driver is at fault, the damage must be claimed through the Client's comprehensive insurance policy. The Client is responsible for paying any insurance excess/deductibles required by their insurer, unless otherwise agreed in writing.

7. Driver Safety & Code of Conduct

Our drivers represent our values of professional, polite, and safe transit. Drivers are prohibited from smoking, playing music at excessive volumes, or engaging in reckless driving behavior.

We maintain a zero-tolerance policy towards abusive, threatening, or illegal behavior from Clients. The driver has the right to immediately terminate the trip and drop the passengers at a safe public location if the Client or passengers act in a manner that compromises the safety of the driver, the vehicle, or other road users.

8. Privacy & Personal Data Protection

We collect and process your personal data (name, phone number, location, and destination) solely for the purpose of booking confirmation and service delivery. We do not sell, rent, or share your personal data with third-party marketers.

We use secure servers and communication networks to handle data transmission and ensure absolute confidentiality for our corporate and personal clients.
